BuyBoard® Privacy Policy

General

This BuyBoard Privacy Policy (“Policy”) covers how the BuyBoard handles personal information collected and received from or through the BuyBoard website, the online application at buyboard.com, and our use of information collected about you through the BuyBoard online marketplace application and social media pages (the BuyBoard website, online marketplace application, and social media pages are collectively referred to herein as the “Site”). As used in this Policy, the term “BuyBoard,” “we,” or “us” shall include the Texas Association of School Boards, Inc. (“TASB”) and all affiliated entities to which TASB provides website services on this Site (e.g., The Local Government Purchasing Cooperative and National Purchasing Cooperative). This Policy applies to information BuyBoard collects in connection with use of the Site.  It does not apply to information collected by others, such as BuyBoard vendors or BuyBoard members through their websites.

Personal information is information about you that ordinarily would not be publicly available and that identifies you individually, such as your name, residential address, personal e-mail address, geolocation (your mobile internet device’s longitudinal and latitudinal information), and personal phone number. This Policy does not apply to the practices of entities or people that BuyBoard does not employ, manage, or control.

Accessing the Site and Personal Information Collection

You are not required to be a BuyBoard member or to provide personal information to access certain parts of the Site. When you access the Site without actively providing any personal information, we may collect limited technical information, such as your IP address and geolocation. We also use cookies and analytics as described below.

Certain parts of the Site do require that you provide us with personal information for access to or use of those parts. For example, if you are authorized to use a portion of the Site that is password-protected, you may be required to provide information as described in the “Secure Site Access” section below. You may also provide information if you participate in a chat session through a live chat feature, if offered, by third-party providers in some areas of the Site. Cookies

BuyBoard uses cookies (text files placed on your hard drive by a web server) to help personalize and maximize your experience and time online. Cookies are not used to run programs or deliver viruses to your computer. They are uniquely assigned to your computer and can only be read by a web server in the domain that issued the cookie to you. Secure Site Access

Some areas of the Site are secured and can only be accessed by BuyBoard vendors, BuyBoard members, and other authorized users using unique login credentials. You must have a specific user identifier (user ID) and password to access resources through any password-protected portions of the Site. Your login credentials and password are for your use only and strictly confidential. You are responsible for maintaining the confidentiality and security of those credentials, and are responsible for all activity occurring on the Site using your login credentials and password. You are strictly prohibited from any sharing of your login credentials and/or password with any other person(s) and from any use of your login credentials other than for your use of the Site in compliance with this Policy.

Secure Site access may require you to provide the following:

  • Contact information such as your name, address, zip code, phone number, and e-mail address
  • Information describing your role with the BuyBoard member or BuyBoard vendor entity including name of entity, title, and type of access required
  • Other information required by BuyBoard for access.

BuyBoard may use this information, and any other information you provide, to effect transactions or provide services for which the information was provided, to contact you with additional information and updates, and to analyze use of our Site and services.

In some cases, this information may be collected and stored by third parties and therefore may also be subject to their privacy policies. You may review any such policies by contacting those third parties or by reviewing the policies posted on their websites.

How We Collect and Use BuyBoard User Information

BuyBoard collects several types of information from and about BuyBoard users in connection with their use of the Site, including information:

  • Provided by the BuyBoard member or BuyBoard vendor or any authorized user for public or private display;
  • That is or includes personal information, such as email addresses;
  • About your internet connection and usage details; and/or
  • IP addresses or browsing activity.

BuyBoard collects this information:

  • When you directly provide it to us in connection with your use of the Site, for example, when you enter product or purchase information; and/or
  • Automatically as you navigate through the Site. For example, the Site automatically captures the date and time when you access the Site, the IP address from which you access the Site, and your activity on the Site.

As part of the Site, an online marketplace application is made available for BuyBoard members seeking to make purchases from awarded BuyBoard vendors. BuyBoard collects information in connection with this online marketplace, including one or more of:

  • User information, including name and identifying information for the user, identification and personal information of authorized users and BuyBoard member and BuyBoard vendor personnel.
  • Authentication and activity information for authorized users, including access credentials, user profile, access permissions, personal information of authorized users, and access and usage information, including logs of user activity and account activity.
  • Content entered or posted to the Site by you or any authorized user for public or private display (“User Contributions”) including:
    • BuyBoard member purchase information (product searches, purchase orders, requisitions, requests for quotes, invoices, favorites, and similar information submitted in conjunction with shopping and purchases through the BuyBoard marketplace)
    • BuyBoard vendor information (product catalogs, pricelists, responses to requests for quotes, invoices, profiles, announcements and similar information)

Your User Contributions are posted on the Site and transmitted to others at your own risk. Although BuyBoard limits access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, BuyBoard cannot control the actions of other users. Therefore, BuyBoard cannot and does not guarantee that your User Contributions will not be viewed by unauthorized persons. Information you provide in these areas may be subject to, and disclosed under, “public information” laws that apply to The Local Government Purchasing Cooperative, BuyBoard members, or others, so exercise caution when deciding what information to disclose.

Third-Party Data Collection/Online Tracking

BuyBoard may use Google Analytics or other service providers (“Service Providers”) for analytics services.

The Site may include hyperlinks to, or include on or in connection with, the Site (e.g., apps, plug-ins, Application Programming Interfaces ("API"), and Software Development Kits ("SDK"), websites, locations, platforms, applications or services operated by third parties ("Third-Party Service(s)"). These Third-Party Services may use their own cookies, web beacons, and other tracking technology to independently collect information about you and may solicit personally identifiable information from you.

Certain functionalities on the Site permit interactions that you initiate between the Site and certain Third-Party Services, such as third-party social networks ("Social Features"). Examples of Social Features include: enabling you to send content such as contacts and photos between the Site and Third-Party Services; "liking" or "sharing" BuyBoard’s content; logging into the Site using your Third-Party Service account (e.g., using Facebook Connect to sign-in to the Site); and to otherwise connect the Site to a Third-Party Service (e.g., to pull or push information to or from the Site). If you use Social Features, and potentially other Third-Party Services, information you post or provide access to may be publicly displayed on the Site or by the Third-Party Service that you use. Similarly, if you post information on a Third-Party Service that references the BuyBoard (e.g., by using a hashtag associated with BuyBoard or other TASB affiliated entities in a tweet or status update), your post may be used on or in connection with the Site or otherwise by BuyBoard and other TASB affiliated entities. Also, both BuyBoard and the third party may have access to certain information about you and your use of the Site and any Third-Party Service.

BuyBoard may engage and work with Service Providers and other third parties to serve enhancements on the Site and/or on third-party services that support the Site. Some of these may be tailored to your interest based on your browsing of the Site and elsewhere on the internet, which may include use of precise location and/or cross-device data, sometimes referred to as "interest-based advertising" and "online behavioral advertising" ("Online Interest-based Advertising"), which may include sending you an ad on a third-party service after you have left the Site (i.e., "retargeting").

BuyBoard may use Google Analytics or other Service Providers for analytics services. These analytics services may use cookies and other tracking technologies to help BuyBoard analyze BuyBoard users and how they use the Site. Information generated by these services (e.g., your IP address and other usage information) may be transmitted to and stored by these Service Providers on servers in the U.S. (or elsewhere) and these Service Providers may use this information for purposes such as evaluating your use of the Site, compiling statistic reports on the Site’s activity, and providing other services relating to Site activity and other internet usage.

BuyBoard is not responsible for, and makes no representations regarding, the policies or business practices of any third parties, including, without limitation, analytics Service Providers and Third-Party Services associated with the Site, and encourages you to familiarize yourself with and consult their privacy policies and terms of use.

How Information Collected about You Is Used

BuyBoard uses information that it collects about you or that you provide, including any personal information, in order to:

  • Present the Site and its contents to you;
  • Store your preferences regarding use of the Site;
  • Troubleshoot and provide user support for the Site;
  • Fulfill any other purpose for which you provide it;
  • Provide you with notices about your account;
  • Carry out our obligations and enforce rights arising from any contracts entered into between you and us, including for purchase activity, billing, and collection;
  • Notify you about changes to the Site or any products or services offered or provided by BuyBoard, TASB and TASB affiliated entities;
  • Allow you to participate in interactive features on the Site;
  • Use the information in any other way we describe when you provide the information; and
  • Use for any other purposes with your consent.

Disclosure of Your Information

BuyBoard may disclose aggregated information about BuyBoard users, and information that does not disclose personally identifiable information, without restriction.

Notwithstanding the above, BuyBoard may disclose personal information that we collect or you provide as described in this Policy:

  • To contractors, service providers, and other third parties we use to make available the Site.
  • To other TASB service divisions and TASB affiliated entities.
  • To fulfill the purpose for which you provide it. For example, if you give us an email address to receive purchase orders, we will transmit your email address to BuyBoard members who may issue a purchase order.
  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

BuyBoard may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government-authorized or regulatory request or where required by applicable public information laws.
  • To enforce or apply the BuyBoard Terms and Conditions of Use, any agreement with you, and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of BuyBoard, our members, or others.

Links

The Site contains links to other websites. BuyBoard is not responsible for the privacy practices of sites other than our own. We encourage you to be aware of the privacy statements on other websites and to read these statements.

Online Forums and Message Boards

The Site may make forums and message boards available to our members. Information you disclose in these areas may become public, so exercise caution when deciding what information to disclose.

Social Media

The collection and use of information on social media websites and applications are governed by their own privacy policies. Please remember that any information posted on or through BuyBoard pages such as Facebook, Twitter, Instagram, and Pinterest, or on other social media pages or channels, is subject to the policies and practices of the applicable social media channel.

We may receive personal information from a social media site platform or application when you connect through a social media feed, post content, or otherwise interact with us using social ;media tools. For example, we may receive basic Facebook account information (name, e‑mail, gender, birthday, current city, and profile picture URL) through Facebook. Also, when you “like” us, or send a “Tweet” to us through a social media channel, we may receive your username, handle, and any other available personal information from the social media site or application. All information received from social media sites and applications is treated and used in the same manner and for the same purposes as described in this Policy with respect to similar information we obtain through the Site.

Geolocation Information

We may receive information about your geolocation and your mobile internet device when you use our Site. We may use this information to provide you with location-based services and information. Most mobile internet devices allow you to turn off geolocation, and we encourage you to contact your device manufacturer for detailed instructions on how to do so.

Children’s Privacy

We are committed to complying with all applicable laws and regulations regarding the collection, storage, and use of personal information of minors under the age of 18, including the Children’s Online Privacy Protection Act of 1998.

We do not collect personal information from minors under the age of 18. Individuals under the age of 18 are not permitted to use the Site without the supervision of a parent or legal guardian. We do not knowingly collect or solicit personal information from children under the age of 18 or knowingly allow such persons to register for an online account or to place orders or provide personal information through the Site. If we learn that someone under the age of 18 has provided any personal information through the Site, we will remove and permanently delete that information as soon as reasonably possible.

If you are a parent or guardian who believes that your minor under the age of 18 has submitted personal information or other information to us without your consent, please contact us using the contact information provided below. Once we verify that you are the parent or legal guardian, we will cooperate with you to discuss what, if any, personal information we have collected about your child and how that information may have been shared or used.

Updates to This Policy

BuyBoard may modify this Policy at any time. When changes are made, we will update the version date at the bottom of the Policy. Your use of BuyBoard’s Services following these changes means that you accept the revised Policy.

Correcting Your Information

We strive to assure the correctness of the information we maintain. If the information we have about you is inaccurate, we will correct the information in a manner as timely as possible. To provide us with corrections, please contact us in any of the following ways:

Security

We employ reasonable security methods to prevent unauthorized access, maintain data accuracy, and ensure correct use of your information. However, no data transmission over the internet or any wireless network can be guaranteed to be perfectly secure. As a result, while we try to protect your information, we cannot ensure or guarantee the security of any information you transmit to us, and you do so at your own risk.
